Jordan going off the road is considered an accident but if the other car never collided with hers and they drove past each other with Jordan going off the road after the fact, then I'm not sure you can say the other car was involved in an accident. Jordan crossed over into the other lane, over-corrected and went off the road. That seems all on her, not the other driver. There's a good chance the other driver never even knew she went off the road since she did so after they had gone past each other. I don't see how you prosecute someone for not reporting something they didn't know happened.

ETA: I'm not questioning the police wanting to talk to the other driver. I totally get that. It's Dante being all "I'm going to prosecute them!" that makes no sense to me. Nothing in this accident indicates the other drive deserves to be brought up on charges when the accident was because Jordan was driving distracted and admits she was.
